Mass Kah Acquitted and Discharged on Sedition Charges Share
The messenger at the leading Foroyaa Newspaper in The Gambia, Mass Kah was acquitted and discharged by Magistrate Aji Amie Jagne at the Kanifing magistrate court on the 09 September 2014. Mass Kah was charged with sedition and accused of bringing hatred, disaffection and disrespect to the president's person and the particulars of the offences were that Mass Kah had a verbal exchange with two young people in Latrikunda, who wanted to paste the president of The Gambia's photo on a car on the 1 November 2013. He told to them to that they can paste the picture in the sky. Mass Kah was detained for over almost 13 days without charge at unknown places around the country and at one time at the notorious NIA, without access to an attorney or his family, contrary to his fundamental rights guaranteed under the constitution. He was subsequently charged and remanded at the mosquito infected Mile 2 prisons until he was granted bail. They appeared traumatized and preferred to say very little.At his private residence in Kotu, this reporter met the caretaker and two boys said to be Mr. Sabally’s children. An effort to interview his wife proved unsuccessful.Prior to his removal from the cabinet on 7st July, 2014, Mr. Sabally was moved from the position of Secretary General, Head of the Civil Service and Minister of Presidential Affairs and reassigned to the portfolio of Minister of Higher Education, Research, Science and Technology.Mr. Sabally is facing two counts of ‘Abuse of office’ and ‘Economic crimes’ before Justice Mikailu Abdulahi of the Banjul High Court. He pleaded not guilty to both charges.EDIITOR’S NOTEHis case was adjourned for hearing on 14th October, 2014 at the High Court in Banjul. This means two months of detention without court appearance. No information is available on any effort being made to secure bail before the trial. Remand prisoners also have rights. Foroyaa would be ready to meet any family member who wishes to confirm that those rights are being protected as he remains a remanded prisoner under the custody of the NIA.
