They are definitely keeping close watch on swingstages and window  washing 
rigs. Owners and CMs I know of are chasing after smokers.  It's my  
understanding that as of Jan 1, They (I'm not sure if that's NYCDOB or  OSHA) are 
requiring everybody on site to wear brightly colored safety  vests, and safety 
glasses (even for those of us who are already foureyes).
 
So I would say the answer is "yes."  Sharpshooter will no doubt say  no, 
just to spite me.
