At the beginning of this month I posted the article by this title.

Four people replied, quoted here, and all kinda echoed each other and my own thoughts (bold emphasis is mine, although the entire responses are worth reading)

Thank you for sharing this article. 
I ate at this restaurant twice last summer with total confidence in the waiter and kitchen. Happily, I was fine after both meals. 
Personally, I wish folks wouldn’t sue restaurants because the negative publicity could possibly result in them no longer offering GF options.
I prefer to speak directly to the manager/ owner or head chef if I have a concern. My philosophy is that accidental gluten ingestion just like accidental food poisoning for the general dining public is a reality for all of us.

Wow!!! To think all the times I got glutened at a restaurant. I never would have thought about suing. It’s my choice to take that risk. That’s why most restaurants dont say gluten free they say gluten sensitive. I have celiac disease and have those same symptoms when accidentally ingesting it. Thank god ive only had it happened a handful of times. I stick to places I know are safe.

So, in my opinion, this is going to make it MORE difficult for us to eat out because restaurants are going to fear getting sued.   What a shame.

This upsets me a great deal. It is because of lawsuits like this that restaurants are afraid to offer anything at all that is GF. Yes, we must be careful. Scrupulous indeed. And I am not questioning the “permanent” nature of the injury  (well, maybe I am a little) but if the victim is as careful about his diet as is suggested and is as sensitive as suggested, I must ask why he bothers to eat out at all. I certainly wouldn’t if I were in his shoes. 
I’m not trying to stir up a controversy, and I am very sorry this happened, but I don’t think suing restaurants for hundreds of thousands of dollars is the key to getting served GF food. In fact, it just has the opposite effect.
