Publication of list of candidates for the election of President of the Republic of February 26, 2012

DECISION

The Constitutional Council in its meeting of January 27, 2012 ruling on electoral matters and decided to stop publishing the list of candidates for election to the President of the Republic whose first ballot was set for February 26, 2012;
Given the Constitution, particularly Articles 30 and 28.29; Having regard to 

Articles 1L115 LO LO 122 of the Electoral Code;

Given Organic Law n '92-23 of 30 M.ai 1992 on the Constitutional Council, as amended;
Considering Decree No. 2010-1 "L5 519 of November 2010 fixing the date of the presidential election in February 26, 2012;
Mindful of decree n "201L-1-976 of 20 December 2011 to convene the electorate;
Given the evidence produced and attached to nomination; Rapporteur heard the report.

1/CONSIDERANT that under Article 28 of the Constitution "any candidate for President of the Republic must be exclusively of Senegalese nationality, enjoy his civil and political rights and 35 years old at least on election day.He must know how to write, read and speak the official language ";

2/CONSIDERANT that pursuant to Section 29 of the Constitution,''any application to be admissible, must be submitted by a political party or coalition of parties legally constituted or be accompanied by the signature of voters representing at least ten thousand registered resident in six regions at five cents less per region.
Independent candidates, such as political parties are required to comply with Article 4 of the Constitution. Each party or coalition of political parties may submit only one application. "

3/CONSIDERANT that Article 27 of the Constitution provides that the term of the President of the Republic is seven years ... mandate is renewable only once, that section L04 of the Constitution provides that the President of the Republic continues in office until his term, all other provisions of this Constitution apply to it;

4/CONSIDERANT that under Article 30 of the Constitution, the Constitutional Council shall adopt and publish the list of candidates twenty-nine (29) days before the first ballot;

5/CONSIDERANT than January 4, 2012, Moustapha Niasse, born in 1939 in Keur Madiabel, civil administrator, had a copy of the registry of the Constitutional Council a statement to the effect that he is a candidate for the presidential election of February 26, 2012, that it received the investiture of the coalition Benno Siggil Sénégaal, he chose to print its ballots green color with yellow border and, for symbol, six hands holding the wrist and a circle on a yellow background.

6 / WHEREAS January 19, 2012, Macky Sall, born December 11, 1961 in Fatick, Engineer, had a copy of the registry of the Constitutional Council a statement to the effect that he is a candidate for the presidential election of February 26, 2012, that it received the investiture of the''coalition''Macky 2012; he chose to print their ballots the brown and beige, and its symbol, the horse's head.

7/CONSIDERANT than January 20, 2012, Idrissa Seck was born August 9, 1959, in Thies, Auditor Consultant, had a copy of the registry of the Constitutional Council a statement to the effect that he is a candidate for the presidential election of February 26, 2012; he received the investiture of the''coalition''President Idy 4, he chose to print its ballots to the color orange 3 / 4 and the light blue in Y4, and symbol , an orange on a branch with two leaves;

8/CONSIDERANT than January 24, 2012 Abdourahmane SARR, born March 26, 1968 in Paris, residing at L5 lot, area of a milk Almadies file at the registry of the Constitutional Council a statement to the effect that it is an independent candidate in the presidential election February 26, 2012, he received ten thousand (10,000) signatures of registered voters residing in six regions at a rate of five hundred (500) at least by region, he chose to print its ballots vote blue-gray color and the symbol of a dove gray with a blue wave and below the wave Abdourahmane upper and fine print, and CARS in capital letters and in large print with four (4) stars below.

9/CONSIDERANT than January 24, 2012, Abdoulaye Wade, born May 29, 1926 in St. Louis had a copy of the registry of the Constitutional Council a statement to the effect that he is a candidate for the presidential election of February 26, 2012, that He received the investiture of the Senegalese Democratic Party (PDS) and the Allied coalition in 2072, he chose to print their ballots the color yellow, and blue writing, symbol for an ear of millet .

10/CONSIDERANT than January 24, 2012, Mor Dieng, born 6 September l958 to Mbacké chartered accountant, had a copy of the registry of the Constitutional Council a statement to the effect that he is a candidate for president in February 2012 da26, that he received the nomination of the Party of Hope Yaakaar, he chose to print their ballots and the color purple, the symbol, an orange hit by the initial Y in purple surrounded by white a green leaf on top of the orange and the acronym Yaakaar Party of Hope in purple and orange;

22/CONSIDERANT that under section LO LL6 of the Election Code, the nomination must be accompanied by independent, including a list of voters representing at least ten thousand (10,000) registered resident in six (6) regions at a rate of five hundred (500) region comprising at least first names, name, date and place of birth, indication of the electoral registration and signature of the interested parties;

23/CONSIDERANT it results from the checks which have been conducted in accordance with the provisions of article LO 120 of the Election Code, as Abdourahmane CARS has produced a list of L0 000 voters supporting a candidate whose only eight thousand one hundred (8100) have been identified and validated signatures and that therefore a candidate who does not meet the requirements of Article LO 116 should be declared inadmissible;

24ICONSIDERANT that Keba KEINDE independent candidate has produced a list de12100 voters supporting his candidacy which only 8154 were identified and validated signatures and that therefore a candidate who does not meet the requirements of Article LO 1L6 should be declared inadmissible;
Youssou Ndour 25/CONSIDERANT as an independent candidate has produced a list of 12,936 voters supporting a candidate whose only 891L were identified and validated signatures, and that therefore a candidate who does not meet the requirements of section 115 must be SO declared inadmissible. DECIDES

ARTICLE I: The bid Abdourahmane CARS is inadmissible. Article 2: Youssou Ndour's candidacy is declared inadmissible, Article 3: Bid KEBA KEINDE is declared inadmissible, Article 4: The list of candidates in the first round of the election of the President of the Republic of February 26, 2012 is stopped in the order of nominations as follows:

Idrissa Seck;
Abdoulaye WADE;
Mor Dieng;
