I'm sure the FCC has something to do with it.  As to the exact federal
regulation or CFR, I couldn't tell you.  However, the 53k limitation is
usually written on the outside of the box the the modem hardware comes in and
it's also usually written in very small print on modem ads.  Something like
this would appear on a 56k modem ad "actual speed may vary.  Federal
regulations limit download speeds to 53k"
