Elhajj,
It is not rally the Justice Dept but the Judiciary Department. You must be
able to distinguish between the two. I have been folloing the case closely.
What is happening is that the Sheriff's Bailiff together with the Ag.
Judicial Secratary Mr. Ousman Jammeh arranged a secret sale to one buyer
called Macarthy of the sale of Babanding Sissoho,s plane- the 727. They
claimed that it was an auction but how can it be an auction when it was not
advertised in the right way according to law.The lawyers challenging the
sale was Mr. Ousman Sillah and Amie Bensouda together with Fatou Bomm
Bensouda. The trio were able to prove that Mr. Gibril Badjie and Mr. Ousman
Jammeh did not annouce it over the radio, did not paste it at the Airport
and did not paste it at the high Court as they claimed . Mind you the
lawyers got GRTS, GAMTEL, AIRPORT, etc to write and say that all that MR
Ousman Jammeh and Badjie claimed were never done.
When they saw that they will be exposed they made Mr Antouman Gaye the
lawyer for Babanding and Mr. Boto the representative of Babanding to see the
Judge-Justice Ihekire and bribe him. He came to court and said that the sale
was proper. The Lawyers appeled and asked the Court to stay the transfer of
the aircraft until the case was finished. This time the group - Gibril
Badjie, Ousman Jammeh, Antouman Gaye, Mr.Boto went to see Mr. Tarik Musa the
judgement creditor on whose behalf the action was brought, to ask him to
tell the lawyers to withdraw the appeal and they will pay him 6 million
dalasis as part of the settlement of his debt that Babanding owes him, he
has agreed and they have paid him. His Lawyer has withdrawn the appeal.
This is a short victory for the group because Amie Bensouda and Fatou
Bensouda have now brought another action on behalf of Kabo Airlines to set
aside the sale and to order another auction sale so that Kabo airlines can
have opportunity to bid. Infact Kabo airlines is offering 9 million whilst
Mr. Macarty is offering only 8 million. What everybody is wondering is why
the Lawyer of aBabanding Mr Gaye, his Representatiive Mr. Boto, Mr. Ousman
Jammeh and Mr. Badjie all want the 8 million instead of the 9 million. I
know why because they have ben given 200,000 US$ to share amongst themselves
and support the sale. This is why they are fighting very hard to keep the
sale but knowing Amie Bensouda , she will fight to see that Justice is done.
In the mean time on the application of Amie Bensouda the Court has ordered
that the aircraft should not be transfered untill the case is finished.
What the Ag. judicial Secretary Ousman Jammeh and Gibril Badjie dont know is
that the NIA are keeping a close watch over this case.I will keep you
posted.
