Well Ebrima, in the spirit of what Yaya is doing with A.K. Savage, we will
also offer him a carrot and a stick. We will leave the carrot to your
sources and other well-meaning Gambians. However, we have this to say to
A.K. Savage. This government is fighting a losing battle. Their legal (or
should we say, illegal) postures cannot be defended by the best legal minds
in The Gambia, let alone novices that were called to the Bar less than a
dozen of years ago. We in the opposition will be after him like bulls after
red clothes. We will scrutinize each and every move he makes with his green
lawyers. If he takes indefensible positions, we will disgrace him in court
and before the whole world. We will record all his moves and when the day of
judgment comes, he will account for every advise he ever gave to Yaya and
his illegal regime. So we urge A.K. Savage to spare himself and his family
from this war. Pap Cheyassin Secka is a lot better lawyer than he is, and
yet Secka is routed in court day in day out. Again, let Savage do some
introspection. How long has he been called to the Bar? How many cases has he
won? How many statutes has he drafted? Does he have the guts to contradict
Yaya? Can he stand up to veteran lawyers like Ousainou Darboe, Antouman Gaye
and Ousaman Sillah? What makes him think that he can succeed where Fafa,
Marong, Sisay, Bittaye, Nyang and Secka failed?
Well if A.K. Savage or any other incompetent lawyer decides to take the
position, let them know that they will be doing so at their own peril. I can
guarantee them that we will fight them to the end.
Ebrima, the news about the dropping of the charges is also a welcomed one.
Your source is right. One does not have to be a lawyer to figure out that
this latest news clearly has an impact on the pending murder charges against
Darboe and his 24 supporters. Clearly 80 people cannot be accused of the
murder of one person. If I remember right, there was a body the pathologists
could autopsy. I submit that if 80 people attacked that one vermin, there
will be no body at the end of the day. The question is now a matter of
elimination. Who among the people there was more likely to register the
fatal blow? As I said earlier on, Darboe is the least likely person to do
that. So using that logic alone, he should be eliminated from the list of
accused persons. The AG has a big problem in his hands with regards to this
case. As in most cases, the law is not on their side. Aside from the self
defense issue which everyone with the slightest common sense knows, the AG
also has to prove that Mr. X participated in the act (stabbing, if my
recollection serves me right) that caused the death (causation in legal
parlance). Just how are they going to establish that Darboe registered the
fatal blow? Was the fracas video-taped? Is there a murder weapon with
Darboe's fingerprints on it? This is laughable. This case should be thrown
out of court forthwith.
