Following the introduction of the 1997 Constitution of
The Gambia, the Judicial Committee of the Privy
Council ceased to have supervisory juridictions over
the Gambia. During the First Republic, The Judicial
Comittee of Privy Council were active in hearing
appeals from the Gambia on constitutional matters. a
classic case worthy of mentioning is that of Attorney
General of The Gambia vs Momodou Jobe 1980. The 1997
Constitution has finally severed links with The Privy
Council and the Supreme Court of the Gambia is now the
final Court of Appeal in the Gambia. Having said so,
the Gambia Government have still not resolved their
decision to appeal against the judgement delivered in
the Treason Trial of the Farafenni 4; Sulayman Sarr
and 3 others.
With regards to other members of the commonwealth, the
role of the Judicial Committee has in the past years
being restricted to Commonwealth States in the
Caribean States Like Jamaica, Antiguca, St Lucia. You
will be surprise to know none of the Anglophone states
within Africa seeks judicial assistance from the Privy
Council and their Supreme Courst .
