As was expected I got a lot of replies to this one. Finally heard from the company and this is what they had to say:
Hello Terri,

Dear Valued Customer,

 

I would like to apologize for any concern you may have had regarding the labeling of our riceWORKS chips.  I would like to assure you that the product is gluten free.  The oat fiber ingredient is a carbohydrate product with all protein and therefore gluten removed.  The supplier of the ingredient has provided me with a letter from an independent food safety specialist who assessed the product.   He indicated there was no risk of the provocation of celiac disease from ingesting this product.

Several people said they had written and gotten this same response. One lady asked that I not speak for her as she is fine with eating oats. 

Another lady said she had that experience with Bora Bora bars purchased at Costco where the company said the oats were gf.

One person pointed out that They can say they are g.f. because there is NO definition for GF until the FDA voluntary labeling goes into effect in August 2008...After than manufacturers who want to use the term will have to do testing to provide proof their product has less than 20 ppm of gluten. 

The "Read every label, every time" law still applies! 

I'm sure that after the requirements for using "Gluten-free" go into effect, there is will a lot fewer products in the market w/ that label.  And, celiac will be healthier as a result.  



Another pointed out that since tjhere with oats being gluten free in and of themselves there will be more products saying gluten free but containing oats. Until they have to test their product to claim that status we just don't know

Many said to stick to Lundberg rice chips which I certainly intend to do.
