My daughter who is 18 and in H.S. just had her 4th I.E.P. meeting since July
20, 99.  They of course refuse to give her a full time aide while she is in
school.  She takes 4 subjects in school and 2 on homeschooling.  They give no
reason, other then to say that "they" don't believe she needs one.

Today in the cafetaria, she took a bad fall.  She injured her groin and her
left leg was hurt.  She had a Selective Dorsal Rhizotomy done back in Oct.
Well this fall, kicked in her RSD or "shooting pains" in her leg again.

Of course this happened on a Friday afternoon.  She did report it to a member
of the school district, who deals with the handicapped, and left a voice mail
for the resource teacher, who of course left early today.

Being it's late Friday afternoon, we cannot get an appointment with her G.P.
and her Dr. at childrens' hospital didn't return my call.  So, my kid is in
pain and has to live with it until Monday.  It's not an emergency situation.

My question, can I get a lawyer on consignment, to sue the Special School
District and it's individual members who made the decision not to give my
daughter an aide, thus putting her in harms way.  She could very easily have
landed on her head, but she twisted to protect her head and hurt her groin,
left leg and now her butt and shoulder hurt.  I won't have any medical proof,
because it's not life threatening, and by the time I do get an appointment,
hopefully the pain will have gone away, and the shooting pains will have
stopped.  There is no way I can prove that the shooting pains in her legs,
was a direct result of the fall.

I feel the I.E.P. committee is negligent and abusive in creating a situation
where my daughter was hurt.

Right now she is upset and feeling very down and in constant pain.

What can I legally do about this.  I live in St. Louis, Mo.

I would appreciate any input on this matter.
