I don't know if George Felos (Michael Schiavo's attorney) raised the
issue in response to the appeals.  Without the issue being raised, the
justices may have felt that it was not an appropriate issue to address.

yes, it will. and since this was not addressed in any
of the decisions, it is hanging out there that whether
this is really a appropreiate use of article 3 powers.
one of these federal judges should have at least
mentioned it. but it was just left out there.
