Subject: Alsbrook settles

The Alsbrook case, the other ADA attack case which was to come before
the
Supreme Court this spring has just been settled, so the case will not be
going to the Supreme Court.  Two important pieces we are trying to get
final
information on are as follows:

a) What is the effect regarding ADA cases in the 8th Circut District
(IA,
ND, SD, MO, AR, NE, MN)? Some people are saying that still no ADA Title
II
cases can be brought to court in these states, some are saying you can
sue
for "injunctive relief" ie. to get the problem solved BUT no money --
including legal fees.

b) Also, rumor has it another case, the Garret case out of Alabama, is
on
the fast track as the next case the Supreme Court will take up.  (A
woman
with breast cancer who worked for the state) This is another case where
the
constitutionality of the ADA is being brought before the Supreme Court.
Though it was our understanding the Supreme Court decided on what cases
to
hear in each of its sessions and then could take no more until next time
around, it seems this may not be the case here for some reason.  Garret
may
be heard this session, ie. before June.
