I wonder if it has to do with more than luck.  I have noticed during my time
on this list (about which I can't say enough good things), that CSA/USA uses
a much narrower interpretation of "gluten free" than, for example, the
Canadian and Australian celiac associations.  That fact, coupled with the
more litigation prone nature of the American public may be enough to stop
any company dead in their tracks.  I would say Kraft is just covering their
own you know what!
 
Just my immediate thoughts on a provoking issue!
