these devices may fall under an experimental category where you are allowed 
higher power than under other categories like with the in car FM 
transmitters.
Regardless, I seem to remember something about part 97 is it, allowing those 
who hold an amateur radio license being allowed to operate these devices for 
experimental purposes at high power compared to those who do not hold a 
license.
Perhaps that is dreaming though.
Either way, these things are sold all the time and are easily obtainable by 
the general public, which leads me to believe that they are both type 
accepted, and quite legal to use at their high power settings by the average 
person.
