British Columbia Supreme Court Judge Orders College of Physicians & Surgeons to Investigate Thyroid Treatment British Columbia College of Physicians & Surgeons finally ready to hold a public hearing regarding Victoria medical doctors's thyroid treatment.

Public hearing for Dr, David Derry re: thyroid therapy Saturday, September 14, and Sunday, September 15, 2002 9:30 a.m. to 4:30 p.m., Westin Bayshore Hotel Conference Centre Salon A 1601 Bayshore Drive (downtown, near Stanley Park) Vancouver, British Columbia, Canada.

The hearing is scheduled to go from 9:30 a.m. to 4:30 p.m., but people attending are asked to arrive by 9:00 to sign the College guest register and read the Hearing Guidelines. Seating may be limited; please come early if possible.

On the surface, this hearing is for Dr. David Derry and for his patients, who are fighting for the right to have the treatment they choose and that works for them. It's also for the British Columbia College of Physicians & Surgeons; they are under direction from the Supreme Court to hold an investigation into Dr. Derry's treatment if the suspension of Dr. Derry's medical licence is to continue. (See Background for details.)

It's also for you and your right to choose the therapies that you want. If the College wins this battle, we will all lose the right to choose doctors whose treatments may not fit within the narrow scope of what the College deems is acceptable. Whatever our health concerns are, the outcome of this hearing will affect all of us.

If you are a doctor, your professional freedom is being challenged. The College is fighting for control over your right to choose what you consider to be the best therapies, even when the therapies you choose have been documented to be successful. Despite the fact that Dr. Derry has responded to all their questions with numerous medical references, the College is proceeding with this hearing.

Background
On June 11, 2002, the College of Physicians & Surgeons of British Columbia succeeded in temporarily suspending the medical licence of Dr. Derry, a Victoria, British Columbia MD who has successfully treated about two thousand thyroid patients. His success was often after specialists had been unable to help these patients. The College did this after removing Dr. Derry's thyroid prescribing privileges in November 2001. Dr. Derry's license suspension was upheld after the College's legal counsel David Martin told a Supreme Court judge in December 2001 the College would hold a public hearing to investigate Dr. Derry's thyroid treatment practices. Instead of carrying out their court assurances, they looked through files of Dr. Derry's patients with other health conditions, and used the non-thyroid-related deaths of two patients as grounds for suspending his licence.

The College had thus left Dr. Derry without the ability to prescribe thyroid medication for seven months, and then without the means to earn a living. This interim suspension had been planned to coincide shortly before summer, when the College Executive Council members would be taking vacations. All this had happened without a fair investigation into Dr. Derry's treatment and despite his huge success in treating thyroid patients.

On June 25, a Supreme Court judge, Mr. Justice Pitfield, stated that self-governing bodies must be more accountable. [Premier Gordon Campbell please note!] Unless the College holds an investigation into Dr. Derry's treatment by September 30, 2002, the suspension of Dr. Derry's thyroid prescribing privileges and medical licence will no longer be valid. This investigation, if it takes place, must be based on clear evidence.

The College will tell you that this hearing is about a doctor whose treatment is "dangerous." Patients of Dr. Derry will tell you that it's about a witch hunt of a successful MD who treats patients the way he was taught in medical school because it works—but which doesn't fall in line with what pharmaceutical companies push or what sometimes misleading lab results may indicate.
