Dear Listserv members,
After going back and forth and getting absolutely nowhere with a Dannon representative
and then a supervisor I am asking for some clarification regard whether they are in
violation of the 2004 FALCPA (Food Allergen Labeling Consumer Protection Act).
Apparently, everyone who looks into whether they can safely consume Dannon's yogurts
(except for the plain which they say if GF) is satisfied with the company reply that the
source of flavoring could contain wheat. If this is the case then how does FALCPA protect
consumers who believe that the top 8 allergens will be listed on products. We all
celebrated the victory of this legislation that the Task Force worked diligently to get
passed. How is it possible that a company as large and widespread as Dannon can get
away with this and has anyone challenged them? Countless consumers rely on truth of
allergen labeling to make healthy choices everyday.
To review I was told that the Light and Fit flavored yogurts could contain wheat derived
from Ethanol (distilled from grain) and that they can not assure that it is safe. I explained
FALCPA and the provisions right from the FDA website and was put on hold. When she
returned I was told that gluten free labeling was voluntary. I explained that that was
another law and that the top eight allergens, or the possibility of their inclusion in
products, must be clearly stated. I was told that they make the main yogurt product and
it isn't their responsibility to list wheat that comes from one of their suppliers. Huh?
Anyone else see the folly? What do we do as consumers?
