Freelance journalist gets four years in prison or heavy fine for
criticising president
Reporters Without Borders “energetically condemns” the sentence of
four years in prison or fine of 250,000 dalasis (8,000 euros) which a
Banjul court passed today on Fatou Jaw Manneh, a contributor to the
AllGambian.net website, after convicting her of “sedition” for
criticising President Yahya Jammeh in a 2005 article.
“This verdict was not the outcome of due process, it was the result
of the president’s personal desire for revenge,” Reporters Without
Borders said. “It highlights the authoritarian nature of a ruler who
despises the press and uses the police and judicial system for his
personal ends. We are relieved that Manneh was able to raise the
money for the fine and thereby avoid imprisonment, and we reiterate
our solidarity with Gambia’s journalists.”
Concluding proceedings that had dragged on for more than a year, a
court in the Banjul district of Kanifing presided by judge Buba Jawo
today found Manneh guilty of intention to commit sedition,
publication of “seditious words” and publication of “false news
intended to create public fear and alarm.”
After imposing the prison sentence, the judge offered the alternative
“option” of a fine that had to be paid before the end of the day.
Local sources said Manneh managed to raise the amount and will
therefore not have to go to prison.
Manneh normally resides in the United States but has not been able
return there she was arrested on landing at Banjul international
airport on 28 March 2007. The purpose of her trip to Gambia was to
visit her family, which was in mourning.
A former reporter for the privately-owned Daily Observer, she was
tried for an AllGambian.net article in October 2005 in which she
accused President Jammeh of “tearing our beloved country to shreds”
and described him as “a bundle of terror."
Jammeh has been on the Reporters Without Borders list of “Predators
of Press Freedom” since 2005. The list is updated each year.

Une journaliste indépendante condamnée à quatre ans de prison ou une
lourde amende pour avoir critiqué le président
Reporters sans frontières condamne énergiquement la condamnation à
quatre ans de prison ferme ou une “option d’amende”, par un tribunal
de Banjul, de Fatou Jaw Manneh, contributrice du site AllGambian.net,
jugée coupable de plusieurs accusations de “sédition” pour un article
de 2005 critiquant le président gambien Yahya Jammeh.
“Ce verdict exprime le désir de vengeance personnel du Président
envers ceux qui le critiquent, et non une décision de justice
équitable. Cette affaire révèle le caractère autoritaire d’un chef de
l’Etat connu pour son mépris envers la presse et qui utilise les
leviers de la police et de la justice pour servir ses intérêts
personnels. Nous sommes soulagés que Fatou Jaw Manneh ait pu réunir
la somme nécessaire pour échapper à l’incarcération et réaffirmons
notre solidarité avec les journalistes gambiens”, a déclaré
l’organisation.
Le 18 août 2008, après plus d’un an de procédure, un tribunal de
Kanifing, une localité du Grand-Banjul, présidé par le juge Buba
Jawo, a déclaré Fatou Jaw Manneh coupable d’"intention de commettre
un acte de sédition" ("intention to commit sedition"), "publication
de matériel séditieux" ("publication of seditious words") et
"publication de fausses nouvelles dans l’intention de provoquer la
peur et d’alarmer l’opinion" ("publication of false news intended to
create public fear and alarm").
La journaliste, résidant habituellement aux Etats-Unis mais dans
l’impossibilité de quitter le territoire gambien depuis son
arrestation, a été condamnée à quatre ans de prison ou une “option
d’amende” de 250 000 dalasis (environ 8000 euros), payable dans la
journée. Fatou Jaw Manneh est parvenu à réunir la somme et n’ira donc
pas en prison, selon des sources locales.
Ancienne journaliste du quotidien privé Daily Observer et
collaboratrice du site Internet AllGambian.net, Fatou Jaw Manneh
avait été arrêtée le 28 mars 2007 à sa descente d’avion à l’aéroport
international de Banjul, alors qu’elle rendait visite à sa famille en
raison d’un deuil. Elle a été poursuivie pour la publication d’un
article, en octobre 2005, dans lequel elle accusait le président
Yahya Jammeh de "réduire notre cher pays en lambeaux" ("tearing our
beloved country to shreds") et décrivait le chef de l’Etat comme "un
paquet de terreur" ("a bundle of terror").
Le président gambien Yahya Jammeh figure depuis 2005 dans la liste
des “Prédateurs de la liberté de la presse” établie chaque année par
Reporters sans frontières.
