ARBITRARY DECLARATION OF PUBLIC HOLIDAYS
History is the greatest judge of all times. It records all significant
evidence with indelible ink. It is certain to pass its judgment. Those leaders who
behave like public trustees will be absolved and those who live like lords
will be discarded into the dustbin of history. Those who have the unique
opportunity to lead should examine their every step to ensure that it accords with
the letter and spirit of democratic governance.
The first lesson to learn is that in a Republic presidents are presiding
public officers and not monarchs or rulers. If they happen to be males their
wives do not become queens. If they happen to be women their husbands do not
become kings. Presidents have no heirs. Their children are equal in birth with
all other children and do not become first children. Their families are not
first families and their wives and husbands are not first ladies or husbands.
All children in a sovereign Republic are born equal in right and self worth.
A president’s child is not different from any other child. They all deserve
equal treatment before the law.
In a sovereign Republic, the president is accorded powers which are
stipulated by Law. Any exercise of power outside of the bounds established by law be
comes arbitrary. The declaration of a public holiday is no exception.
One may now ask,: Could a public holiday be declared on behalf of a
president on a stage, as Youssou Ndour had done during the APRC’s celebration after
the presidential election? Is it proper to declare a public holiday to
commemorate the birth of a single child to the exclusion of all others?
First and foremost, it must be stated that the declaration of a public
holiday to commemorate the birth of one child constitutes a gross violation of
section 33 of the constitution.
Section 33(1) reads: “All persons shall be equal before the law.”
Subsection (2) adds: “Subject to the provisions of subsection (5), no law
shall make any provision which is discriminatory either of itself or in its
effect.”
Subsection (3) proceeds to indicate: “Subject the provisions of subsection
(5), no person shall be treated in a discriminatory manner by any person
acting by virtue of any law or in the performance of the functions of any public
office or any public authority.”
Sub section 4 defines the expression “discrimination” to mean “affording
different treatment to different persons attributable wholly or mainly to their
respective descriptions by race, colour, gender, language, religion,
political or other opinion, national or social origin, property, birth or other
status, whereby persons of one such description are subjected to disabilities or
restrictions to which persons of another such description are not made
subject, or are accorded privileges or advantages which are accorded to persons of
another such description.”
It is our view that other Gambian children are subjected to discrimination
by affording one child privileges under law, which the other children are not
afforded. What do we mean?
Public holidays can only be declared under the law. The Public Holidays Act
encompasses a schedule providing for statutory public holidays such as the
festival of Id el Fitr (Koriteh), Festival of Id El Adha (Tobaski), Festival of
Maulud Nabi, Christmas day, New Year’s Day, Good Friday, Feast of Saint Mary’
s (Sang Marie), the Assumption and Independence Day.
The executive is further empowered by the Act to appoint special days to be
public holidays by notification in the Gazette.
This leaves no room for arbitrary decisions. It also conveys the need for
some degree of permanence in commemorating a given day as a public holiday. Of
course, this is the reasonable thing for the law to do so that enterprises
could plan better and avoid losses in the millions because of the closure of
their institutions.
We hope the Gambian people can now distinguish the difference between
leaders who behave like humble servants of the people and those who are rulers. A
nation gets the type of leaders or rulers that they put in office with their
votes. Those who succumb to intimidation and inducement get rulers and those
who express their freewill without fear or favour in accordance with the best
dictate of their mind and conscience get leaders and servants. This is the
verdict of history and it is irrevocable.
Concern Over Economic Hardship, Human Rights Raised

Ordinary Gambians have expressed concern over the economic hardship endured
in the country over the last twelve months. In the same vein, people have
also voiced out concern over the state of human rights in The Gambia. These
views were gathered in a special interview conducted by these reporters, who went
to the streets to seek the views of people.
Speaking to these reporters, one Ebrima Bojang, who described himself as a
market vendor, said despite the relative peace in the country, many ordinary
Gambians have undergone serious economic hardship. He pointed out that the
price of basic commodities such as rice and flour have skyrocketed beyond the
reach of many ordinary Gambians. This he pointed out is totally unacceptable in
a country where the capacity of earning has not been enhanced. Bojang further
noted that he and his fellow vendors are constantly harassed by the police
who often drive them from where they stand and sell on the road side.
According to him, this regular displacements and obstacles caused by the police have
put them in a difficult situation, as they have been denied earning income.
Reflecting on 2007, one man who introduced himself as Seedy, remarked that
although the dalasi was reported to have risen, it has not reflected on the
prices of commodities concerned. He explained that one would have thought that
the strengthening of the dalasi against major currencies would have at least
led to the reduction of the prices of basic commodities. He said that despite
the claims that the dalasi is strengthening, the prices of commodities
remain skyrocketing. Seedy also welcomed the twenty percent increment in salaries
and expressed concern over the plight of the unemployed, whom he said are
left at the mercy of more hardship. He suggested that something should be done
about the plight of the unemployed Gambians.
Sarjo Dibba, a businessman at Albert Market, said that the year 2007 has
been a very difficult year, especially for farmers. Mr. Dibba remarked that the
lack of market for the groundnut crop has negatively impacted on farmers;
that government’s decision to announce the price of groundnuts is not enough. He
said government should do everything humanly possible to make sure that
there is a lucrative market for groundnuts. He explained that over the last three
years groundnut buying has been left in the hands of private dealers who,
according to him, have been exploiting the farmers. He also called for an
immediate end to what he said is an apparent exploitation of farmers.
Commenting on the state of business in 2007, Dibba noted that business has
not flourished. He attributed the poor performance of business to what he
called the unpredictable nature of hard currencies in the Gambia over the past
year.
Isatou Jobe and Fatou Jallow, who sell vegetables, both lamented the
hardships experienced in the last year. They said that, as vegetable vendors, the
number of customers had seriously plummeted, resulting in a decrease in their
earnings.
Speaking to these reporters, a restaurant manager, who spoke on conditions
of anonymity, said the increase in the prices of foodstuff, in the past year,
had severely stifled his business. The restaurant manager explained that the
increase in the prices of basic foodstuffs meant that he had to increase the
prices of his products. This, he said, did not often go down well with the
customers, who could not understand the dramatic increase; that as a result, he
had to incur losses on sales and also of some customers. Momodou Njie, a
young man, told these reporters that the state of human rights in the Gambia
leaves a lot to be desired. He pointed out the numerous reports of alleged
torture by security forces. Njie’s views were echoed by many other Gambians who
added that detention of people without charge is rife in the country. They
insisted that detention without trial amounts to gross violation of one’s
fundamental human rights. These people cited the cases of councilor Ousman Jatta,
alias Rambo, of Bakau and Tamba Fofana, a headmaster. According to them, these
two people were unlawfully detained in the past year.
Darboe Urges Court To Dismiss Objection By SoS Firdaus

Ousainou Darboe, the lawyer for the United Democratic Party, the National
Reconciliation Party and the Minority Leader, Momodou Sanneh, in the civil suit
against the Attorney General and the Independent Electoral Commission, has
on Monday urged the Supreme Court, presided over by His Lordship, Justice
Abdou Karim Savage, to dismiss the preliminary objections filed by SoS Marie
Saine Firdaus.
Mr. Darboe said the plaintiffs are challenging the amendments that are made
on the Local Government Act and the Constitution by the National Assembly.
According to him, proceedings against the parliament are brought against the
Attorney General because laws passed by the National Assembly become law
when they are assented to by the president.
Mr. Darboe told the court that the submissions of the Attorney General are
misconceived. He added that the Attorney General, in any common law
jurisdiction, is sued where the state is being challenged, and the authority passing
laws is represented by the Attorney General. Mr. Darboe also said the relief
being sought from the first defendant is not the same with those being sought
from the second defendant, the Independent Electoral Commission (IEC) which is
an independent body from the state.
Hearing on the case continues today at the Supreme Court. The suit filed by
the plaintiffs is questioning the legality of the recent amendments on the
1997 Constitution and the Local Government Act.
These amendments created provisions allowing the president to remove elected
councilors and depriving voters in the Local Government Areas the right to
elect their council chairpersons, through universal adult suffrage; instead
councilors will select their own chairpersons from amongst themselves.
IEC Express Preparedness for Local Gov’t Elections

The Chairman of the Independent Electoral Commission (IEC), Mr. Mustapha
Carayol, has said that his institution is fully prepared for the Local
Government Elections, scheduled for 24 January 2008. Speaking at a briefing on Monday,
7 January, Mustapha L. Carayol said the conference is meant to inform all
stakeholders of his institution’s resolve to conduct free, fair and transparent
Local Government Elections on January 24, 2008. Mr. Carayol said the
commission organized workshops in October, 2007 on the theme “Strengthening the
electoral process of The Gambia” and invited all stakeholders in the electoral
process to participate.
He added that the workshop promoted comprehensive participation in the
forthcoming Local Government Elections from all strata of society. Mr. Carayol
said preparations are in their final stages for the conduct of Local Government
Elections and all voters are advised to contact their respective IEC regional
offices to verify that their names are on the voters’ list.
He added that the IEC has embarked on a voter education exercise which will
go on till 23 January 2008. He said the required materials for the smooth
conduct of the elections are with the commission and they are being distributed
to all the regional officers responsible for the areas where the elections
will be contested. Mr. Carayol noted that interviews of polling staff are being
conducted. He said employees of the commission must be non-partisan and
transparent.
He said training of trainers will be conducted on 12 and 13 January 2008 and
a decentalised training of polling staff will be at the administrative areas
on 19, 20 and 21 January 2008. He added that the training will equip the
polling staff with the information necessary to conduct successful, free and
fair elections. He said the IEC has also invited both local and international
observers and that the main idea for election observation is to give
credibility to the results of the elections.
He said a briefing session will be conducted for the election observers in
order to give them necessary information for the elections.
Mr. Carayol indicated that campaign will start on 9 January and will end on
22 January, 2008. He said the IEC is urging all players in the political
arena to comply with the election campaign ethics.
He urged all registered Gambians to exercise their constitutional right and
vote for their candidate of choice in the elections. In responding to a
question on whether the IEC Basket Fund will support all the party agents, such as
in the previous elections, Mr. Carayol responded that all party agents will
be supported and each will be paid D100.00. He said they also have plans to
decentralise polling stations in future. Mr. Carayol added that all parties
will be given equal access to the public media and any party or candidate who
has the fund can pay for extra coverage in the media. He said counting of
ballot tokens will be held at the various constituencies. On the issue of
vehicles with numberless plates during the campaign period, the Police
Superintendent attached to the IEC, Mr. Fadera, said that the practice is against the law
and that it will be taken care of by the Police.
Sahelian Investment Bank Inaugurated

The Gambia’s first ever Investment Bank, BSIC Gambia limited, on Monday, was
officially inaugurated at its Head Office on Kairaba Avenue, opposite the
Fajara War Cemetery. Banque Sahelo-Saharienne pour L’invetissement et le
Commerce- (BSIC) Gambie Limited, otherwise called Sahelo-Saharienne Bank for
Investment and Commerce (BSIC Gambia Limited) is said to be operating in nine
countries, namely, Benin, Burkina Faso Chad, Libya, Mali, Niger, Senegal, Sudan
and Togo. It has a training centre in Mali and its head office is in Tripoli,
Libya.
The Gambia is said to be its first Anglophone affiliate in West Africa with
another to be opened in Ghana after a month.
In her inaugural statement, the Vice President, Madam Aja Isatou Njie Saidy,
described the establishment of the Bank as timely. She recalled that in
February 1999 Heads of States and Governments of the Sahel signed a treaty to
establish the SEN-SAD community. The Vice President noted that within the
framework of this treaty, it was agreed that a Sahelo-Saharienne Bank be
established. The Bank she added is to provide a comprehensive range of financial and
banking services, including long-term financing for the public and private
sectors to accelerate socio-economic development of the people of the SAHEL and
reduce poverty.
The Vice President, however, urged the bank to devise ways and means of
financing public and private sector development projects on concessionary terms.
She also expressed hope that the Bank will not rely on equity contributions
and deposits to finance its activities, but should be able to raise funds in
the capital market. Madam Njie Saidy noted that they will encourage
investments that will serve as a catalyst to meeting the development objectives of the
poverty reduction and growth strategy in line with the vision 2020 objectives.
She urged the banking fraternity to join efforts by pooling their resources
to optimize their service provision to their clients and the country as a
whole. The Vice President also urged them to be involved in long term lending
for the development of small and medium size enterprises as well as syndicates
for greater ventures. The General Manager and Chairman of BSIC Group, Alhadi
Al Warfalli, said the objectives of the BSIC Group, among others are:
(1) To contribute to the socio economic developments of CEN-SAD
(2) To support the community through the funding of growth sectors
He said their intention is to have five branches this year in Banjul and the
Greater Banjul Catchments
The Governor of Central Bank, Momodou Bamba Saho, who also spoke at the
ceremony urged the shareholders and management of BSIC to always comply with the
Financial Institutions Act 2003 and all Regulations and Guidelines issued by
the Central Bank and to implement appropriate corporate government and
internal control processes to ensure the success of the new venture.

Ismail used money to get what he wanted. Isha complained about Rugi’s
attitude to him. “She hated seeing us together. You have to stop your advances
towards me. Moreover, you have to appreciate the fact that I am already engaged.
I love Badara. Ishallah, he will be my hussy.” Is smiled and said. “I am
harmless. Who knows I can be your husband. Forget about Rugi. She is bossy. She
wants to act elder sister to me which cannot be. She can never be my elder
sister.” He dipped into his purse and took out a bunch of money. He gave it to
Isha. She took it. “I am only interested in your welfare. Feel free to request
for your welfare needs. How about your classes? I hope you are finding it
interesting? It is my hobby to make you happy and bring smile to your face.” “
Thanks!” Isha said. “I’ll drop you home.” “Thank you again for your concern.
” Isha said.
Uncle Pa Getting Worried
Ismail dropped her home. Uncle Pa protested. “You are playing with fire. You
are engaged. Stop that man from giving you lifts. The interpretation will be
ugly. The walls have ears. Break up with Badara if you want to consider
Ismail.” Uncle Pa advised. Isha went into her aunt’s room. Uncle Pa eavesdropped
them. Isha showed her greedy aunt the money and she gleed. “What should I do?
” Isha asked her. “Keep it. It is your luck (‘Worsak’). Keep it from your
Uncle. He is old fashioned and a moralist. He does not live on earth but in
the heavens.” She mocked. Uncle Pa barged into them and exercised his
authority. “Get it back! And be fast about it!” Isha tried to argue. But he remained
firm. “I insist!” Aunty Marie frown and signaled Isha to do otherwise.
Uncle Follows Isha
Uncle Pa suspected Isha and Aunty Marie. He decided to convey Isha to Ismail’
s home and ensured she envelope the cash accompanied by a note.
Ismail Is Disappointed
Ismail’s gateman, Musa received the note on behalf of him. Isha left with
her Uncle Ismail was disappointed with the note which asked him to keep off.
Ismail Confronts Isha
Ismail protested. “Why did you return my money with that harsh note? I am
just a friend. I want to help. That’s all. I don’t want to offend you and your
family. Be reassure of my help and support any day, anytime.” Ismail
stressed.
Rugi And Anita
Rugi and Anita were relaxing in Rugi’s flower garden. Isha came to visit
Rugi. She introduced Isha to Anita. “Ani, darling! This is my closest pal Isha.
We were friends since secondary school. You are two of my closest pals on
earth.” The girls giggled and exchanged warm greetings.
At The Cyber Cafe
The trio visited the cyber cafe. Isha checked her mail and replied Badara.
She was high in the skies. The girls mocked her and called her a love bird.
Badara’s Parents Are Worried
Isha visited her in-laws and was shocked to learn that Badara was in
communicado with them. Aunty Bintou, his mother protested. “No letter, no money,
look at his father, an old pensioner and his siblings. If he writes to you, tell
him we are suffering and we are disappointed that he have forsaken us.”
Aunty Bintou shed emotional tears. Isha went with little cash. She gave it to the
family. “I’ll tell him if he replied my email.” Aunty Bintou thanked Isha
for her concern and kindness.
Badou’s Reply
Badara sent an immediate reply to Isha’s mail. “Darling I was arrested for
drugs. I am innocent. The friends I was squatting with were drugs dealers,
when the police raided we were all arrested. The innocent shall be exalted.
Evidence proved me innocent. I relocated. I don’t want any more trouble. I have
started work and I am living alone. I have not forgotten my promise. Please
do me a favour. Don’t inform my parents. They will be devastated.”
Rugi’s Birthday Party
Rugi celebrated her 21st birthday in glamour and style. As usual, she
invited her best pals Anita and Isha. Ismail was the M.C (Master of Ceremony). He
felt offended being rejected by Isha. He ignored her. Isha felt relieved. She
decided to leave earlier than planned to avoid Ismail’s wrath. He was
pretending. He could not ignore Isha for long. When she left he felt disappointed.
He went after her. He could not catch up with her. He came back. Ismail is
fair complexion, dandy and handsome. Females are attracted to him. Anita is one
of them. She felt a great attraction for Ismail. She started to be jealous of
Isha. She soliloqued. “Look at this fool, I am dying for him and all his
attention is for that snobbish Cinderella. But I am a sophisticated lady. I’ll
use my feminine seductive tricks. He’ll will fall for me. I am attractive and
sophisticated. I’ll get him God’s willing.” She swore.
Rugi Reacts
Rugi caught Anita trying to seduce her brother. She walked out sulkily.
Anita became unhappy. She followed Rugi and enquired. “What is eating you up? It
is your 21st birthday party and you are sulking like this? I am
uncomfortable. I am leaving.” Rugi became noncharlant. “No! You are our guest. You can’t
leave. It is late. Spend the night in the guestroom or better still with your
friend.” Jealousy was all over Rugi. Ismail kissed Anita and ushered her
into the guest room. Rugi followed them displeased.
