Supreme Court Affirms Americans with Disabilities Act

By Jim Baker

The U.S. Supreme Court, by a 6-to-3 majority, affirmed the ability of
the Americans with Disabilities Act (ADA) to regulate accessibility of
public accommodations, including foreign-flag cruise ships. In the
case, Spector v. Norwegian Cruise Line, Douglas Spector and several
other plaintiffs claimed the cruise line required people with
disabilities to pay a premium for an accessible room, travel with a
companion, waive any medical liability, and reside in a limited number
of less attractive cabins. In addition, there were no accessible public
restrooms onboard the ship.

Though the Court ruled that the disability law applied to foreign-flag
ships, the majority opinion left a loophole for cruise line operators to
avoid compliance. Justice Anthony Kennedy wrote that only modifications
that did not create international discord or disrupt a ship's "internal
affairs" were necessary.

Stephen Bennett, President and CEO of United Cerebral Palsy, released
the following statement:

"Today, by a 6-to-3 majority, the Supreme Court affirmed the vision of
the Americans with Disabilities Act (ADA) that a nation should not
separate its citizens with disabilities from society."

"The architects of the ADA endorsed provisions that require all places
of public life to be accessible to Americans with disabilities. Clearly,
their intent was to ensure that citizens with disabilities were not just
able to access public services that make life possible, but places that
make life worthwhile."
