  On my machine, the "Always use this program" box comes up already
checked (so clicking on it would turn it OFF), UNLESS the file I've
chosen has no extension to its name, in which case it is unchecked
and available but (as you describe) has no effect.  [The mechanism
which associates a particular application with a particular extension
makes no provision for files without extensions.]
  Note also that once an association has been made, that application
will be used if "Open" is selected -- "Open with..." will still offer
the opportunity to choose which application to use, and in contexts
where you get "Open With ->", a second menu lists all of the
applications you've used with this extension.

  Without more detail, it's not clear that your system is doing
anything it shouldn't, or not doing something it should.  And I
suppose details of this behaviour might vary amongst the various
modern versions of Windows:  95, 98, ME, NT4, 2000 and XP.  I've
tested this behaviour on 2000; I'm pretty certain my NT4 and 98 boxes
work the same way, but perhaps not -- and I don't know what you use.
