Second anniversary of police raid that effectively banned independent  
weekly

On the second anniversary of a police raid on the privately-owned  
weekly The Independent, Reporters Without Borders calls on the  
government to lift the illegal and unofficial ban that has prevented  
the newspaper from publishing for the past two years.

“By suppressing a newspaper that was often very critical, the  
government broke the laws that it requires Gambians to respect under  
pain of severe penalties,” the press freedom organisation said.  
“President Yahya Jammeh renders accounts to no one, in violation of  
the rules of democracy. He makes no secret of his contempt for media  
independence and his impunity is assured by the level of fear that  
his crackdowns impose.”

The raid on The Independent was carried out on the morning of 28  
March 2006 by members of the Criminal Investigation Department and  
the elite Police Intervention Unit, who arrested all of the staff  
present. They were all released later the same day, except the new  
managing editor, Madi Ceesay, head of the Gambia Press Union, the  
country’s main journalists’ union.

The previous night, at around midnight, police had arrested the  
editor, Musa Saidykhan, at his home. Ceesay and Saidykhan were  
finally released on bail three weeks later, on 20 April 2006. One of  
the newspaper’s reporters, Lamin Fatty, was arrested on 12 April 2006  
and was released on bail two months later.

The authorities never gave any reason for the raid or explained on  
what legal grounds it was carried out. But it came just one day after  
the newspaper published a story quoting opposition National Alliance  
for Democracy and Development leader Halifa Sallah as asking if  
President Jammeh was “richer than The Gambia.” Ceesay wrote an  
editorial for the same issue criticising all coups, both the abortive  
one that had reportedly taken place six days earlier and the one that  
brought Jammeh to power in 1994.

The Independent’s disappearance means that The Point – whose joint  
editor, Deyda Hydara, was murdered on 16 December 2004 – is the only  
independent newspaper still being published in Gambia. The privately- 
owned Daily Observer chose several years ago to position itself as a  
close ally of the government.

L'hebdomadaire privé The Independent est illégalement empêché de  
paraître depuis deux ans

Reporters sans frontières appelle le gouvernement gambien à lever les  
mesures empêchant, depuis le 28 mars 2006, l'hebdomadaire privé The  
Independent de paraître depuis deux ans.

"Faisant fi des lois qu'il demande aux Gambiens de respecter sous  
peine d'être sévèrement sanctionnés, le gouvernement a mis à mort un  
journal connu pour son ton critique à l'égard de son pouvoir. Malgré  
cela, en contradiction avec les règles démocratiques, le président  
Yahya Jammeh ne rend de comptes à personne. Lui qui ne fait pas  
mystère de son mépris pour l'indépendance des journalistes a imposé  
un tel climat à son pays que la crainte de la répression garantit son  
impunité", a déclaré l'organisation.

Les locaux de The Independent ont été investis et fermés de force par  
des agents du Département d’investigation criminelle (CID, brigade  
criminelle) et de la Police Intervention Unit, une unité d’élite, au  
matin du 28 mars 2006. Le personnel présent sur place a été arrêté,  
puis relâché plus tard dans la journée, à l’exception du nouveau  
directeur du journal, Madi Ceesay, par ailleurs président de la  
Gambia Press Union (GPU), le principal syndicat de journalistes  
gambiens. La nuit précédente, autour de minuit, le rédacteur en chef  
du journal, Musa Saidykhan, avait été arrêté à son domicile. Madi  
Ceesay et Musa Saidykhan ont été relâchés sous caution le 20 avril,  
tandis que le journaliste Lamin Fatty, arrêté le 12 avril, a été  
relâché sous caution le 12 juin.

Même si les autorités n'ont fourni aucune explication et ne se sont  
appuyées sur aucune disposition légale, cette opération faisait suite  
à la publication, dans l’édition du 27 mars, d’un article citant le  
leader de la coalition National Alliance for Democracy and  
Development (NADD, opposition), Halifa Sallah, qui se demandait si le  
président Yahya Jammeh était "plus riche que la Gambie". Dans ce  
numéro, Madi Ceesay avait signé un éditorial dans lequel il  
critiquait les coups d’Etat, celui qui a échoué à renverser le  
président Yahya Jammeh le 21 mars 2006 comme celui qui l’a porté au  
pouvoir, en 1994.

Avec la disparition de The Independent, le quotidien privé The Point,  
cofondé par Deyda Hydara, assassiné le 16 décembre 2004, est la  
dernière publication indépendante paraissant en Gambie. Le quotidien  
privé The Daily Observer, quant à lui, a adopté depuis plusieurs  
années une ligne éditoriale en étroite connivence avec le gouvernement.
