Now that the Gambia is no more a member of the British Commonwealth,
should non-Gambians be allowed as judges? Can legal scholars help?

Should Gambians cry or dance to the news that "the former Chief Justice
Maame Agyaemang disappeared without trace.." and that H.E.P.A...., with
abundant resources, "..does not know where she is."

GAMBIA HAS NEW CHIEF JUSTICE

A press release from the President’s Office informs the public of the
swearing in of a new Chief Justice at a swearing in ceremony that took
place yesterday March 6th 2014 at state house in Banjul. According to
the release broadcast over state owned GRTS, the Gambian president Yahya
Jammeh has appointed Mr. Ali Nawaz Chowhan, a Pakistani national to the
position of Chief Justice, the highest position of the Gambian
Judiciary. Two other judges were sworn-in, in the names of Justice
Emmanuel Fagbenle and Justice Oduma who are not new to the Gambian
judiciary.

Speaking at the Swearing-in ceremony, the President said among other
things that the role of the judiciary is to judge suspects referred to
them and his role is to implement what the judiciary decided. He
emphasised that he does not judge, but only implement judgments.
He thanked the newly sworn Chief Justice for accepting the challenge and
said this is the first time during a swearing in ceremony, a judge
quoted sections of the Gambia constitution and compare it with other
constitutions citing sections in our constitution that are not in other
constitutions.
He said he has no doubt in his ability and integrity because of the
trust he has in him.
He also congratulateed Justice Fagbenle and Oduma for their long service
to the Gambia. Justice Fagbenle and Oduma are newly sworn in to serve as
the President of the Gambia Court of Appeal and a High court judge of
the Gambia respectively. President Jammeh said the former Chief Justice
Maame Agyaemang disappeared without trace and he does not know where she
is.

He however informs the public that they are trying to figure out where
she is whether in the country or outside the country.
The Gambian president said the country’s relationship with Pakistan is
cordial and described it as more than friendly which offers training to
the Gambia Armed Forces. The Gambia has witnessed the change in position
of the highest post in the Judiciary for the fourth time in a row in the
last two years.

UNITED NATIONS (BY THE GENERAL ASSEMBLY) AND WORKED AS SUCH FOR THE UN
AT THE HAGUE THE NETHERLANDS 2006 – 2009 WITH THE (DIPLOMATIC) STATUS OF
UNDER SECRETARY GENERAL OF THE U.N.
