Le directeur de L'Exclusif inculpé et écroué à la maison d'arrêt dans  
l'attente de son procès pour "offense au chef de l'Etat"

Reporters sans frontières est stupéfaite par le placement sous les  
verrous de Moussa Guèye, directeur de publication du quotidien privé  
L'Exclusif, inculpé le 15 octobre 2007 d'"offense au chef de l'Etat"  
et "diffusion de fausses nouvelles" pour avoir évoqué, dans son  
journal, des "escapades nocturnes" du président Abdoulaye Wade.

"Le président sénégalais compte désormais un prisonnier personnel,  
accusé d'avoir porté atteinte à la prétendue sacralité de sa  
personne. Emprisonné en vertu d'une loi archaïque et grâce à des  
procédés iniques, ce journaliste doit être libéré. Le chef de l'Etat  
devrait comprendre, une fois pour toutes, que ce type d'épisodes  
désolants n'apporte pas de réponse juste à un conflit opposant la  
presse et les autorités", a déclaré l'organisation.

Déféré au parquet une semaine après son arrestation, Moussa Guèye a  
été entendu par un juge d'instruction et inculpé, conformément aux  
réquisitions du procureur, en vertu des articles 80, 254, 255 et 270  
du code pénal, relatifs à la "diffusion de fausses nouvelles",  
l'"offense au chef de l'Etat" et le "trouble à l'ordre public". Il  
est poursuivi pour la publication, dans L'Exclusif du 8 octobre, d'un  
article intitulé "Les escapades nocturnes du président Wade". Un  
mandat de dépôt a été émis. Moussa Guèye a été écroué à la maison  
d'arrêt de Rebeuss, dans l'attente de son procès.

L'Exclusif editor jailed pending trial for “insulting the president”

Reporters Without Borders is stunned to learn that Moussa Gueye, the  
editor of the privately-owned daily L'Exclusif, was placed in pre- 
trial custody yesterday on charges of insulting President Abdoulaye  
Wade and reporting “false information” in an article about his  
“nocturnal escapades.”

“Senegal’s president now has a personal prisoner accused of attacking  
his apparently sacred status,” the press freedom organisation said.  
“Arrested in an illegal manner and held under an archaic law, Gueye  
must be freed. President Wade needs to understand once and for all  
that such an appalling episode is no way to handle conflicts between  
the press and the authorities.”

Finally brought before an investigating judge one week after his  
arrest, Gueye was charged at the prosecutor’s request under articles  
80, 254, 255 and 270 of the criminal code with “disseminating false  
news,” “insulting the president” and “disturbing public order” in a  
report in the 8 October issue headlined “President Wade’s nocturnal  
escapades.” The judge ordered him to be detained pending trial. He is  
being held in Rebeuss prison.
