You should also go after the receiver of the damaged package as they should 
have filed a claim immediately, it should have been the receiver, not the 
shipper who filed the claim.

How can you file for damages to a parcel you do not have in your possession?

I received a damaged piece of electronics I purchased from someone on ebay. 
The box was severely damaged by UPS.  I kept all the packing and when they 
came to inspect, they paid for the damaged goods based on the condition of 
the box.
