I think you've pretty well got it nailed. The burden of proof is always on 
the side of the person doing the complaining and in addition to the FCC and 
ARRL, they might want to talk to a lawyer about a nice, firm letter to the 
building superintendent, pointing out their legal rights if they were to be 
evicted. Perhaps there's a local lawyer who's also a licensed amateur 
(notice how I managed to avoid using "lawyer" and "ham" in the same 
sentence?).
