COUP SUSPECT FLED COUNTRY, WITNESS TELLS TREASON TRIAL Posted Tuesday, June 10, 2003 by Editor
Inspector Biram Jobe has told the High Court yesterday that he was informed that a co-accused of Dumo Sarho and five others, Abdoulie Sanyang, has fled the country.
In his examination-in-chief, Inspector Jobe revealed that Sanyang was one time under NIA detention and that he did not know how he left the NIA custody.
Public prosecutor Akomaye Agim then attempted to tender Abdoulie Sanyang's statement through Inspector Jobe to which the defence counsel raised objection.
Defence Counsel Mai Fatty argued that there was no conclusive evidence that Sanyang could be accessible by the court and added that Inspector Jobe's statement was not reliable.
Both counsel Ousman Sillah and Ousainou Darboe associated themselves with their colleague. According to Sillah, the statement was inadmissible as it would tantamount to hearsay evidence. He submitted that with reference to court records, he (Sanyang) was originally an accused person before charges against him were dropped, and granted bail by the NIA.
Presiding judge, Ahmed Belgore, rejected this statement.
Another statement made by one Kasim Keita was also rejected. However, the statements of Lt Omar Darboe, Lt Lalo Jaiteh, Ebrima Yarboe and Dumo Sarho were tendered without objection by the defence.
During cross-examination by Mai Fatty, Inspector Jobe disclosed that the original copies of the statements of the accused persons, which were not available in court, were given to former DPP Gloria Davies. He added that she sent those documents to Senegal for the extradition of Alhagie Kanteh and that he had no idea as to whether the documents were received in Senegal or whether the extradition proceedings ever started.
The case was adjourned to June 16 for continuation of the cross-examination
