How come some people (penis free, brass-balled, or otherwise unencumbered,
encumbered, or cucumbered) can wear patent leather pumps, and others can't
wear Grucci Loafers?

Sounds like discrimination to me.  Let's sue the bastards, and/or sisters of
bastards, and return Elian to the closet with his non-fisherman friend!
